A Fort Walton Beach Man Is Behind Bars For Interfering With Child Custody And Lewd Or Lascivious Battery On A 15 Year Old

A 25-year old man that said he thought the female he was involved with in December was 18, has now been charged with a felony offense for having sex with a 15-year old.

A Okaloosa County Sheriff’s Office deputy first made contact with Justin Terrell Chivers of 65 Lincoln Drive in Fort Walton Beach pertaining to his investigation of a missing juvenile who was possibly at his residence.

During the encounter with Chivers, he denied any knowledge of who the missing juvenile was and where she might be. Chivers was informed of the consequences of harboring a runaway and was asked again if he had any knowledge of her whereabouts. Chivers stated for a second time he did not.The deputy then walked to his patrol car and returned a short time later.

Upon the deputy’s return, he asked Chivers’ for consent to search the residence for the missing juvenile. According to the arrest report, Chivers stated he did not feel comfortable without his sister’s permission who was currently at work.

Contact was made with the sister who granted consent to search of the residence. During the search of the residence, the missing juvenile was located the garage.

After obtaining permission from the juvenile to look through her phone, the deputy discovered a text message from Chivers advising he was on his way to pick her up.

Based on that information, Chivers was arrested and charged with interference with custody on December 19th.

During interviews, the girl told authorities she met Chivers through a mutual friend and that the pair had consensual sex throughout the weekend from December 16th to the 18th . The teen also told investigators she and a friend colluded to lie about her age, telling Chivers she was 17.

Chivers, who was arrested yesterday on charges of lewd or lascivious battery with a person between the ages of twelve and sixteen, says at one point he asked to see the victim’s identification but she would not provide it.

Investigators on the case discovered Chivers and the teen texted frequently, and although there was no explicit talk of sexual activities the messages revealed a “very assertive victim in the pursuit of the defendant, such as asking to come visit and expressing jealously of other women”.

Chivers remains in custody at the Okaloosa County Department of Corrections with a $20,000.00 bond.
